Terms and Conditions for purchasing our Goods and Services

Definitions:

•    Goods means goods provided by Espresso Warehouse to you. Services means services provided by Espresso Warehouse to you. ‘You means the person(s) purchasing goods or services from Espresso Warehouse which these conditions apply.

Orders:

•    You may place your order for a good or service by (i) ordering online on our website www.espressowarehouse.com.au; (ii) by phone by ringing 1300ESPWHS; (iii) by fax to our offices 02 8966 4366
•    All orders are subject to availability of stock and minimum / maximum order quantities as established by us.
•    We reserve the right to refuse orders whether whole or in part, at our absolute discretion.

Deliveries:

•    We will endeavour to deliver our goods or services to you in a timely manner to the address specified on your order.
•    However if you wish to have our goods or services delivered to you by means other than our standard, then you will be required to make all the necessary arrangements and pay all associated costs.

Payment:

•    Espresso Warehouse may change our prices without notice to you.
•    Unless a trading account has been agreed upon with set terms, then invoices for any goods or services must be paid prior to shipment, or at the time of delivery.

Title and Risk:

•    Title in Goods passes to you upon payment of goods.
•    Risk in Goods passes to you upon delivery of the goods to you.

Returns:

•    We pride ourselves on delivering the highest quality merchandise. If any merchandise arrives that does not meet this high standard, we will gladly replace or reimburse the merchandise.
•    Notification of returns must be made within 7days of receipt of the goods.
•    You must verify the quantity and quality of goods received, and notify us within seven days if items received are deemed faulty. Otherwise you waive the right to reject them.
•    We will only accept returned goods if they are in their original condition and packaging and accompanied by the invoice.
•    When the return is completed we will reimburse the price of the returned goods and the freight charge associated with your returning the goods, within 30 days of receipt of the goods.
•    You cannot refuse goods on the basis that they are not delivered by any given date.
•    Espresso Warehouse will be under no obligation to accept goods returned for any reason, except as required by law.

Machine Warranty

•    Our machines come with a manufacturer’s warranty of either 1 or 2 years for the date of purchase. Espresso Warehouse offer an extended warranty of 3 years for all JURA equipment purchased at no extra cost, on the basis that the manufacturer’s conditions of the warranty are not breached.  Espresso Warehouse is not the manufacturer for the purposes of this warranty. Where require we will assist you with a warranty claim against the manufacturer’s designated agent Global Coffee Solutions.

Liability

•    Espresso Warehouse’s only liability in respect of Goods or Services is as stated in these terms. To the extent permitted by law all other liability is excluded.

General

•    These terms and any invoice referencing these conditions govern the provision of our Goods and Services to you, and constitute the whole of the agreement between us and supersede any previous dealings and arrangements.
•    These terms and conditions are governed by the laws of New South Wales.
•    The parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales and courts of appeal from those courts. Each party waives any right it has to object to an action being brought in those courts.
